Legal Notice

Last updated: October 10, 2026

“NOVA” means Nova Internet Services, Inc., including its assumed names and brands.
“Site” means NOVA’s own websites.
“Systems” means the network, servers, and services NOVA operates, including those on which NOVA’s customers host their own websites, email, and other content.
“Customer Content” means content that NOVA’s customers place on or send through the Systems. Customer Content belongs to the customer, not to NOVA.

These Terms of Use apply to your use of the Site and the Systems.

By using the Site or the Systems, you agree to all terms, conditions, and notices contained or referenced here (the “Terms of Use”). If you do not agree to these Terms of Use, please do not use the Site or the Systems. We may update or revise these Terms of Use at our discretion. Please check them periodically for changes. Your continued use of the Site or the Systems after changes are posted constitutes acceptance of those changes.

You agree to abide by NOVA’s Rules of User Conduct, including but not limited to agreeing not to use this site for any unlawful purpose.

This site may link to other sites on the internet. Those sites are not under NOVA’s control, and NOVA is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of their content. A link does not imply endorsement of a site by NOVA or any association with its operators.

Content you host with NOVA or send through NOVA’s services remains yours. You represent that you own or otherwise control the rights to that content, and that hosting, transmitting, or displaying it through NOVA’s services will not infringe or violate the rights of any third party. NOVA does not review content before it is placed on its systems. NOVA may remove or disable access to any content on its systems at any time, including in response to a notice of claimed infringement, and is not liable to you for doing so.

If you believe that your work has been copied and is accessible on this site, or on a site hosted by NOVA, in a way that constitutes copyright infringement, please send a written notice to NOVA’s designated agent:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you believe has been infringed.
  3. Identification of the material you believe is infringing, with enough detail for us to locate it, such as its web address.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

When NOVA receives a valid notice of claimed infringement, it will promptly remove or disable access to the identified material and notify the customer responsible for it.

If your material was removed and you believe this was the result of a mistake or misidentification, you may send a written counter-notification to the designated agent above. It should include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any district in which NOVA may be found), and that you will accept service of process from the person who sent the original notice.

NOVA will send a copy of the counter-notification to the person who sent the original notice. Unless that person informs NOVA that they have filed a court action, NOVA may restore the material 10 to 14 business days after receiving the counter-notification.

NOVA will terminate, in appropriate circumstances, the accounts of customers who are repeat infringers.

ALL MATERIALS, INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THIS SITE (THE “CONTENT”) ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE. THE CONTENT IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NOVA, ITS SUBSIDIARIES, AND ITS LICENSORS DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE, OR CORRECT; THAT THIS SITE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE CONTENT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THIS SITE IS SOLELY AT YOUR RISK. BECAUSE SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES, THESE EXCLUSIONS MAY NOT APPLY TO YOU.

UNDER NO CIRCUMSTANCES SHALL NOVA, ITS SUBSIDIARIES, OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SITE. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF NOVA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, NOVA’S LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

Upon request by NOVA, you agree to defend, indemnify, and hold harmless NOVA and its subsidiary and other affiliated companies, and their employees, contractors, officers, and directors, from all liabilities, claims, and expenses, including attorney’s fees, that arise from your use or misuse of this site. NOVA reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with NOVA in asserting any available defenses.

NOVA makes no representation that materials on this site are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.

These Terms of Use are governed by and construed in accordance with the laws of the State of Texas, excluding its conflicts of law rules. You agree that any claim or action arising out of or relating to these Terms of Use or your use of this site shall be filed only in the state or federal courts located in the State of Texas, and you submit to the personal jurisdiction of those courts for the purpose of litigating any such claim or action.

Unless otherwise specified here, this agreement constitutes the entire agreement between you and NOVA with respect to this site. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

NOVA reserves the right, in its sole discretion, to terminate your access to all or part of this site, with or without notice.
